What is an RFE?
An RFE, known as a Request for Evidence, is a request from USCIS that requires additional information before the officers may assess a pending application. Most importantly, it is NOT a denial. Rather, it is a request for additional evidence.
What are some reasons an RFE may be issued?
Depending on the type of case, there could be a variety of reasons as to why an RFE is sent. Some common reasons are: (a) missing or incomplete information, (b) insufficient financial evidence, (c) inadequate proof of a bona fide marriage, (d) insufficient documentation to prove employment, (e) medical examination issues (Form I-693) or (f) unclear information was submitted.
Generally, there is a lack of documentation provided to prove the necessary element. For example, while preparing your forms for an adjustment of status, the Sponsor is required to show they are able to provide financial support to their beneficiary. This requires the Sponsor to submit taxes. If those tax documents are incomplete or deemed uncertifiable, USCIS will send an RFE to clarify.
How is an RFE different from a denial?
An RFE is different from a denial because an RFE is a request, whereas a denial is an answer. Both have a different appeal process, and thus both may be appealed.
