Deferred Action for Childhood Arrivals (DACA) is a program that allows some individuals who were brought to the United States as children and who meet certain other requirements to receive a renewable two-year period of deferred action from deportation and become eligible for a work permit in the United States.

Applicants must have entered the United States prior to their 16th birthday, have lived continuously in the United States since June 15, 2007, and were under age 31 on June 15, 2012 (born on June 16, 1981 or after).

They must also have been physically present in the United States on June 15, 2012, and at the time of making their request for consideration of deferred action with U.S. Citizenship and Immigration Services (USCIS).

In addition, they must not have had lawful status on June 15, 2012. DACA does not provide a path to citizenship or permanent residency. It is important to note that asylum seekers who are seeking asylum through the affirmative asylum process may be eligible for DACA if they meet the requirements listed above.
